HOPLITE INDUSTRIES M10 HAVOC LIABILITY WAIVER
Overview:
Hoplite Industries M10 HAVOC signal & training blank firing device (BFD) has been designed to operate and function safely, however the device can be dangerous and risks personal injury if damaged or used incorrectly. The M10 HAVOC requires the buyer to read, comprehend, agree to, and sign this waiver prior to purchase.
Requirements:
BEFORE any purchase is made, all persons must read all current instructions, warning labels, view training/demonstration videos, and acknowledge this form. This document includes all current warnings in relation to the M10 HAVOC as of December 1st, 2025.
Legal:
It is the sole responsibility of the customer purchasing the M10 HAVOC to ensure they are in compliance with all Federal, State, and Local laws at all times when in possession of, or operating the M10 HAVOC. If the customer has any questions about the legal status of this device, questions may be directed to Hoplite Industries LLC for clarification.
Safety Information:
The device user must read, understand, and follow all current Hoplite Industries warning and training manuals BEFORE operating, or being in the proximity of the operation of the M10 HAVOC. Failure to do so may increase the risk of serious bodily harm to the user or others.
Personal Protective Equipment:
To handle, operate, or witness the M10 HAVOC, all relevant persons must wear the following protective equipment:
- Hearing protection (rated to 180dB)
- Eye protection
- Gloves
Risks and Risk Avoidance:
A BFD deployment can cause the following injuries; temporary or permanent hearing loss, tinnitus, ear drum damage/rupture, temporary or permanent damage to/loss of eyesight, burns to the skin, cuts, abrasions, tearing of skin, nerve damage, dismemberment of fingers/hands. DO NOT deploy the M10 HAVOC near any person or animal.
Secondary injuries that may result are seizures that can be induced in some people, which can result in serious injury or death. This risk may increase in persons with history and diagnosis of epilepsy and seizures.
A person may experience an exaggerated response to the operation of M10 HAVOC deployment, resulting in fainting, loss of balance, and falling.
M10 HAVOC use may contribute towards a startle response, muscle contractions, incapacitation, or severe exhaustion. In a Medically compromised person this may contribute to sudden death.
The effects of the M10 HAVOC may induce startling, panic, fear, anger, rage, discomfort, pain, or fear which may be injurious or fatal for some persons.
Limit number of uses of the M10 HAVOC. DO NOT deploy the M10 HAVOC multiple times simultaneously unless absolutely required. Consecutive exposure may increase the risk of medical complications, especially in those with impaired cardiac function.
Never throw the M10 HAVOC at or near any person. This device is strictly designed for use in training and signaling. Deploying against a person may result in serious injury such as bruising, burns, abrasions, broken/fractured bones, loss of consciousness, or a combination of all these resulting in injury or death.
Long term exposure to the M10 HAVOC may cause certain effects, including physiological and metabolic changes, stress, pain. In some people, the culmination of these effects over prolonged exposure may contribute towards serious injury or death. If these symptoms are observed, minimize or halt deployments of the device.
Deployment:
Significant differences in effects exist between commercially available blank cartridges. Only use blank cartridges supplied by Hoplite Industries, or recommended/approved by Hoplite Industries LLC.
Follow all instructions, training, and warning provided by Hoplite Industries. Failure to do so may result in serious injury or death.
General Precautions:
Unintentional deployment or discharge of the M10 HAVOC may result in serious injury or death to the user or others. Do not store the device loaded, and store the device and all blank ammunition away from any source of ignition, flammable material, or gas. Keep hands and all body parts clear of the blast ports located at the bottom of the device, if the M10 HAVOC discharges unexpectedly, you may be seriously injured. STRICTLY FOLLOW ALL RELOADING STEPS. NEVER MATE THE TWO HALVES OF THE DEVICE WITH A LIVE BLANK, UNTIL ALL THREE SAFETY MECHANISMS HAVE BEEN SUCCESSFULLY ENGAGED. FAILURE TO FOLLOW THE ABOVE INSTRUCTION INDUCES A HIGH CHANCE OF IMMEDIATE AND UNEXPECTED DISCHARGE, WHICH MAY RESULT IN SERIOUS BODILY HARM OR DEATH.
Liability & Release Agreement:
In consideration of, and as a condition precedent to purchase the M10 HAVOC I acknowledge and agree as follows:I have read, fully understand, and accept the risks. I have read, fully understand, and accept the risks as stated in this document and Hoplite Industries current warnings, and that these risks exist.I accept the Risks, understanding the Risks, I assume all Risks inherent in M10 HAVOC use and exposure, whether known or unknown, foreseen or unforeseen.I accept that it is solely of the buyer to know and adhere to any and all Federal, State, and Local rules, regulations, and laws pertaining to the ownership, possession, Transportation, and deployment of the M10 HAVOC.Release and hold Harmless. I Release and hold Harmless Hoplite Industries LLC, its agents, representatives, officers, directors, partners, employees, distributors, and the (collectively “Released parties”), from any and all claims, including but not limited to, claims for strict liability, breach of warranty, failure to warn, or any other theory of liability whatsoever even if due to NEGLEGENCE or GROSS NEGLEGENCE of the Released Parties. I specifically waive any statutory rights I may have regarding the release of unknown claims. I agree no one will sue the Released Parties. I promise that neither I nor anyone on my behalf will ever sue or bring legal action or claim against the Released Parties for anything relating to the M10 HAVOC use.This Agreement supersedes any other representation. This release supersedes any other statement, agreement, or representation, written or oral, concerning my M10 HAVOC use and exposure.This Agreement is a binding contract. I intend this form be legally binding upon me, my heirs, executors, administrators, attorneys and assigns. This agreement is contractual and not a mere recital. If any part of this agreement is held vague, invalid, or otherwise unenforceable, the rest of the agreement will continue in full force and effect. I am competent to be bound by this agreement. I affirm that I am competent to enter into and be bound by this agreement; that I have read and understand Liability & Release Agreement in its entirety; that I have not been induced to acknowledge and confirm this agreement by any promise or representation; and that I sign it voluntarily on my own behalf.
